General Terms and Conditions (GTC) of WORKS ON SKIN Friebe Albers Bauer Dechant Walter Wygrabek GbR
1. General overview
The website worksonskin.com is operated by WORKS ON SKIN Friebe Albers Bauer Dechant Walter Wygrabek GbR (hereinafter referred to as "WORKS ON SKIN"). The following General Terms and Conditions (GTC) govern the contractual relationship between WORKS ON SKIN and the purchasers of our tattoo templates and certificates (hereinafter referred to as "buyers” resp. “owners").
By ordering our products, the buyer accepts these terms and conditions. By agreeing to these GTCs, the buyer represents that he is at least the age of majority in his state or province of residence. Please read these GTCs carefully before accessing or using our website!
2. Product description
WORKS ON SKIN offers tattoo templates and certificates that entitle the buyer to have the respective work of art realized on the skin. These are sold as limited art editions (herein referred to as “editions”). The buyer will receive a C4 envelope. Included in the delivery are a high-quality numbered laser print of the motif in DIN A4 format, the same motif on numbered transfer paper for uncomplicated implementation by a tattoo artist / tattoo studio of choice, a personally dedicated, numbered and signed certificate entitling the buyer to realize the WORK ON SKIN edition.
Each edition has a total number of 100 pieces plus 10 artist's proofs (APs). A work shall only be deemed to have been realized once it has been engraved on the skin of the respective owner, an image of it (JPG format) has been sent to info@worksonskin.com and published on the website under the respective edition number. The choice of the person carrying out the work is the responsibility of the respective owner.
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
3. Individualized certificates and non-refundability.
The certificates are individualized to the buyer by first name and surname as indicated in the ordering process. Hence, in legal terms our editions are personalized custom-made products, which invalidates the statutory right of return. By ordering our product the buyer agrees to the exclusion of the right of return and the right to reimbursement of the purchase price.
In order to be compliant with the EU Distance Selling Act, we allow a “cooling off”-period of 14 days after the online purchase to elapse before we individualize the certificate. Within this period, the buyer has the right to withdraw from the purchase by informing us by email. If the buyer wishes to speed up the delivery process, he or she can notify us via the notification field in the order form, thereby completely waiving his or her right to withdraw from the purchase.
4. Restrictions of purchase
Our editions by default are available exclusively online through the website. The rule "first come, first serve" applies to the worldwide online sale. However, only natural persons can purchase one copy from each edition. Editions can only be purchased by natural persons who have identified and legitimized themselves via registration, login and purchase via the website worksonskin.com or during stationary sales by means of personal documents (ID card, passport, driver's license).
Each motif can only be purchased once per person. However, several different editions from our offer can be purchased by one and the same person depending on availability.
5. Rights of use and transfer
The buyer acquires the right to have the tattoo template realized on the skin in accordance with the certificate and legally becomes the “first owner” being entered by name in the certificate matching the edition number. There can always only be one owner of any WORKS ON SKIN edition number.
Contrary to the usual edition market, WORKS ON SKIN edition may not be resold (by appointment and on behalf of the artist). In the event of a resale of which we become aware, the authorized character as an original work expires. However, they may be given away or passed on. The certificate offers the possibility of a threefold transfer by crossing out the previous owner and entering a new owner.
The first purchaser of WORKS ON SKIN tattoo templates and certificates, who has identified and legitimized himself by registering, logging in and purchasing via the website worksonskin.com or at the stationary sale by means of personal documents (ID card, passport, driver's license), is automatically entered in the certificate as the first owner.
The transfer of a WORKS ON SKIN (tattoo template and certificate) may be carried out by the respective owner (or their legitimate heirs) by crossing out the previous owner and entering a new owner on the certificate. After the transfer has taken place, a new realization maycan be made under the respective edition number according to 6. “Realization of work”.
6. Realization of work
Regarding the status of the WORK ON SKIN as part of the artist's official recognized body of work: owners and tattooists act legally as authorized representatives in order to realize one of the artist's works "on behalf of the artist". A WORK ON SKIN is only fully realized when it has been realized on the skin of the respective owner, the realization has been documented on the certificate, a photograph (JPG. format) has been sent by e-mail to info@worksonskin.com and this has been published on the website www.worksonskin.com. Until then it is a “work in limbo”.
7. Order and conclusion of contract
The purchase contract is concluded when the buyer completes and submits the order form on the WORKS ON SKIN website and WORKS ON SKIN accepts the order by sending a confirmation e-mail.
The buyer agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service or any contact on the website, without express written permission by us.This applies in particular to the artists’ biographies, the descriptions of editions and and digital illustrations of motifs.
WORKS ON SKIN reserves the right to refuse orders by anyone for any reason at any time.
8. Prices and terms of payment
Prices vary according to availability and edition numbers. The buyer is not entitled to a specific edition number. All prices quoted on the website are net prices.The final price charged is made up of the net price plus a 2.5% contribution to the “Artist solidarity fund” plus shipping costs depending on the buyer's delivery address plus 19% German VAT (delivery address in Germany). The contribution to the “Artist solidarity fund” is a non-profit component to cover costs that serve the artists’ social security (such as “Verwerteabgabe der Künstlersozialkasse (KSK)”) or artists’ fair payment (such as “Folgerechtsabgabe” der VG-Bildkunst after german § 26 UrhG), the unused funds wil be used for charitable purposes after a period of 3 years.
Payment shall be made in advance or via the payment methods specified on the website.
9. Delivery
Delivery shall be made exclusively to the address specified by the buyer. Delivery times are non-binding unless a binding delivery date has been expressly agreed. At this point we would like to emphasize the additional delay caused by the 14-day "cooling off" period under EU law, which can be avoided by making a note on the online order form.
10. Liability and warranty
WORKS ON SKIN is only liable for damages caused by intentional or grossly negligent behavior. Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on our website is inaccurate at any time without prior notice (including after you have submitted your order).
In no case shall WORKS ON SKIN, our directors or employees be liable for any injury, loss or consequential damages that occur in the process of the realization of our editions by third parties on the skin of the owners. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
The statutory warranty applies insofar as it is not excluded or limited by these GTC.
11. Privacy policy and data protection
The data required for business transactions are stored and processed in compliance with the statutory provisions.

12. Final provisions
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contract is, as far as legally permissible, the registered office of WORKS ON SKIN.
Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
These GTC come into force on August 31, 2024.
